SAMPLE CONTRACT
The following agreement is between “KJROX KENNELS/Ken & April Syers”, hereafter referred to as “BREEDER” and “ _______________ ”, hereafter referred to as “PURCHASER”, for the sale and purchase of one pure AKC PUPPY.

TERMS: In consideration of a purchase price of __________, of which $350 is a non-refundable deposit, the Breeder transfers all rights, privileges and responsibilities associated with the owner ship of the previously listed Doberman dog to the Purchaser on the date specified at the signing of this contract. This represents the entire agreement between the Breeder and the Purchaser.
USE of ANIMAL: We agree that the dog is not being purchased for resale nor will it be used or trained for activities that are inhumane or illegal. Such violations will result in the immediate return of animal to Breeder with no compensation.
HEALTH: The Breeder warrants the dog to be in good physical and social health for the first 96 hours. Animal is guaranteed to be free of any life threatening genetic diseases when diagnosed by 12 months of age. Purchaser agrees to have the animal examined by a licensed Vet. within 48 hours of delivery. Contract is void if Purchaser does not have the animal examined with in the 48 hour requirement. Purchaser may return the animal within 96 hours for any reason, provided that the purchaser has not damaged or harmed the animal, for a full refund less the non-refundable deposit and less shipping fees. Purchaser is responsible for all shipping/delivery charges to receive or return any animal. No returns or refunds for cosmetic surgery.
In the event of the emergence of any life threatening disorder within 12 months of the animal’s birth, which is considered sufficiently serious in the opinion of two unrelated, qualified vets, one of whom will be selected by the Breeder, the Breeder agrees to replace the animal. The original animal must be either put down or returned to the Breeder at the Purchaser’s expense. The Breeder is not responsible for the termination or the return of animal. Upon termination of the animal or return of the animal the Breeder agrees to the following.
Replace the dog with equivalent breeding from the next available litter. The replacement animal may not be from the exact same parents. Breeder will pick the replacement animal and is not responsible for delivery or shipping charges of the replacement animal. NOTE: KJROX KENNELS does not refund cash at any time past the 96 hr return window.
OWNERSHIP REQUIREMENTS: The Purchaser agrees to maintain the dog in a humane environment and properly train and care for the animal. Specifically the animal will be properly licensed and inoculated for communicable diseases as recommended by a qualified Vet. The dog will not be allowed to roam, and will be properly trained to ensure the Purchaser can safely handle and maintain the animal. Buyer assumes all risk of loss or injury to the dog as well as cost of transportation and veterinary care relating to the dogs welfare, sale, or possible replacement.. No warranty exists pertaining to the future show success or breeding result from the dog. Breeder is not liable for lost or stolen dogs. The Breeder strongly recommends permanent identification by tattoo or microchip.
RIGHT OF RECOVERY: In the event that the Purchaser is unable or unwilling to provide an appropriate home in accordance to the terms of this agreement, the dog will be returned to the Breeder. Purchaser agrees to notify the Breeder in writing if any such contingency arises and will not abandon the animal at a shelter, sell or giveaway the animal without written permission from Breeder. If the animal is found to be abandoned, sold or given away with out permission from the Breeder, the Breeder may take legal action against the original Purchaser. The original Purchaser will also be held liable for all legal expenses occurred by the breeder to secure the return of the animal’s residence to the Breeder.
This contract is to be governed by the laws of the State of Kansas. Should any legal proceedings need to be pursued by either party, they must be held in Linn County in the state of Kansas in the United States of America.
By signing this contract both the Breeder and Purchaser agree to the terms and conditions outlined in this contract.
