SAMPLE AKC PET CONTRACT KJROXKENNELS
The following agreement is between “KJROX KENNELS/Ken & April Syers”, hereafter referred to as “BREEDER” and hereafter referred to as “PURCHASER”, for the sale and purchase of one purebred AKC PET registered Doberman Pincher.
SIRE: LANCELOT LYRE OF BLACK MAGIC LAND
DAM: SATIVA’S RAZIN A RUKUS “DIVA”
TERMS In consideration of a purchase price of $1000, of which $350 is a non-refundable deposit, the Breeder transfers all rights, privileges and responsibilities associated with the owner ship of the previously listed Doberman Pincher dog to the Purchaser on the date specified at the signing of this contract. This represents the entire agreement between the Breeder and the Purchaser.
USE of ANIMAL We agree that the dog is not being purchased for resale nor will it be used or trained for activities that are inhumane or illegal. Animal is not to be used for breeding. Such violations will result in the immediate return of animal to Breeder with no compensation.
HEALTH The Breeder warrants the dog to be in good physical and social health for the first 96 hours. Purchaser agrees to have the animal examined by a licensed Vet. within 96 hours of delivery. A copy of the initial Vet. Examination will be mailed to the Breeder within 30 days of signing this contract. Contract is void if Purchaser does not have the animal examined with in the 96 hour requirement or does not provide the breeder a copy of the initial examination within 30 days. Purchaser may return the animal within 96 hours for any reason, provided that the purchaser has not damaged or harmed the animal, for a full refund less the non-refundable deposit and shipping fees. Animal is guaranteed to be free of any life threatening genetic diseases when diagnosed by 24 months of age. Purchaser is responsible for all shipping/delivery charges to receive or return any animal. No returns or refunds for cosmetic surgery or ear cropping.
In the event of the emergence of any life threatening disorder within 24 months of the animal’s birth, which is considered sufficiently serious in the opinion of two unrelated, qualified vets, one of whom will be selected by the Breeder, the Breeder agrees to replace the animal. The original animal must be returned to the Breeder. The Breeder is not responsible for the return of animal. Upon return of the animal the Breeder agrees to the following.
Replace the dog with equivalent breeding from the next available litter. Buyer will be granted a pick from the next available breeding. The replacement animal may not be from the exact same parents. Breeder is not responsible for delivery or shipping charges of the replacement animal. NOTE: KJROX KENNELS does not refund cash at any time past the 96 hr return window.
SHIPPING Arranging pick-up or delivery of the animal purchased is the Buyer’s responsibility. All fees and shipping chargers are the Buyer’s responsibility. In the event that shipping is arranged by the Breeder, Shipping fees are non-refundable. The Breeder agrees to purchase insurance on the shipping of the animal through the transportation service provider. In the event of a paid insurance claim to the Breeder from the transportation service provider, the Breeder agrees to forward the insurance claim payment to the Purchaser, up to but not to exceed the full purchase price.
OWNERSHIP REQUIREMENTS: The Purchaser agrees to maintain the dog in a humane environment and properly train and care for the animal. Specifically the animal will be properly licensed and inoculated for communicable diseases as recommended by a qualified Vet. The dog will not be allowed to roam, and will be properly trained to ensure the Purchaser can safely handle and maintain the animal. Buyer assumes all risk of loss or injury to the dog as well as cost of transportation and veterinary care relating to the dogs welfare, sale, or possible replacement. No warranty exists pertaining to the future show success or breeding result from the dog. Breeder is not liable for lost or stolen dogs. The Breeder strongly recommends permanent identification by tattoo or microchip.
RIGHT OF RECOVERY Breeder will provide a permanent home and care to any animal produced by the breeder for the life of said animal. In the event that the Purchaser is unable or unwilling to provide an appropriate home in accordance to the terms of this agreement, the dog will be returned to the Breeder. Purchaser agrees to notify the Breeder in writing if any such contingency arises and will not abandon the animal at a shelter, sell or giveaway the animal without written permission from Breeder. If the animal is found to be abandoned, sold, at a shelter/pound or given away with out permission from the Breeder, the Breeder may take legal action against the original Purchaser. The original Purchaser will also be held liable for all legal expenses occurred by the breeder to secure the return of the animal’s residence to the Breeder
This contract is to be governed by the laws of the State of Missouri. Should any legal proceedings need to be pursued by either party, they must be held in Johnson County in the state of Missouri in the United States of America.
By signing this contract both the Breeder and Purchaser agree to the terms and conditions outlined in this contract.
